India's Supreme Court has refused to rule on the legality of same-sex marriages, deferring responsibility for legislating on the matter to parliamentarians. The decision is a setback for LGBT activists who had attempted to bypass elected political power, given the BJP government's firm opposition to same-sex unions. Although the Supreme Court decriminalized homosexuality in 2018, this time it refused to rule on same-sex marriage. However, it did affirm that two men or two women can marry if one of them identifies as "transgender". To date, Taiwan remains the only country in Asia where same-sex marriage is legal.
